Data controller
The controller of personal data processed in connection with visits to nearya.eu is Yurii Mostovenko.
Contact for personal data protection matters only: kontakt@nearya.eu.
Nature of the website
nearya.eu is a purely informational website. It contains no forms, registration, user accounts or newsletter, does not sell anything and does not accept orders.
What data is processed
Each time a page is displayed, the visitor's browser automatically transmits the technical data needed to deliver it, in particular the IP address, as well as the browser type, the time of the request and the address of the requested page. This data is processed by the website's infrastructure provider (section 5).
The controller does not collect any other personal data, does not combine technical data with other information and does not attempt to identify visitors.
Purpose and legal basis
Technical data is processed to deliver the page and to ensure its security and proper operation, including protection against abuse.
The legal basis is Article 6(1)(f) GDPR. The controller's legitimate interest is making the website available to visitors and ensuring its security and availability.
Recipients of data
The recipient of the data is Cloudflare, Inc. (USA), the website's hosting and network infrastructure provider, acting as a processor under a data processing agreement (Cloudflare Data Processing Addendum). The current list of Cloudflare's sub-processors is available at: https://www.cloudflare.com/gdpr/subprocessors/.
The controller does not share the data with any other recipients.
Transfers outside the European Economic Area
Because Cloudflare's infrastructure is used, data may be transferred to the United States. The transfer is based on the European Commission's adequacy decision under the EU-U.S. Data Privacy Framework (Article 45 GDPR), in which Cloudflare, Inc. participates. Should that basis cease to apply, the standard contractual clauses adopted by the European Commission (Article 46(2)(c) GDPR), provided for in the agreement with Cloudflare, apply.
A copy of the safeguards applied can be obtained by contacting the controller at the address given in section 1.
Retention period
The controller does not keep its own visit logs, does not store technical data and does not use Cloudflare services for exporting logs or retaining them for longer. Cloudflare processes the data for as long as necessary to deliver the page and ensure its security (including detecting and repelling attacks), in line with the data retention rules Cloudflare applies as a processor.
Rights of the data subject
Under the conditions set out in the GDPR, you have the right to:
- access the data (Article 15),
- rectify it (Article 16),
- erase it (Article 17),
- restrict processing (Article 18),
- object to processing based on legitimate interest (Article 21).
You also have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), the Polish supervisory authority (ul. Stawki 2, 00-193 Warszawa, uodo.gov.pl).
Whether providing data is required
Technical data is transmitted automatically by the browser. Its transmission is a condition for displaying the page; without it, the website cannot be used.
Automated decision-making and profiling
The data is not used for automated decision-making or profiling (Article 22 GDPR).
Cookies and similar technologies
nearya.eu does not store its own cookies or any other information on the visitor's device (including in localStorage); the choice of language version is not remembered.
Cloudflare, as the provider of the infrastructure delivering the page, may where necessary set technical cookies used solely for security, e.g. __cf_bm (recognising automated traffic) or cf_clearance (confirming that a security check has been passed). Such cookies are necessary to provide the service requested by the user and do not require consent (Article 399(3)(2) of the Polish Electronic Communications Law of 12 July 2024 — Prawo komunikacji elektronicznej). They are not used for analytics, marketing or tracking, which is why the website does not display a cookie consent banner.
Links to other websites
The website may contain links to external pages. Once you move to another website, its controller determines how data is processed.
Changes to this policy
This policy may be updated if the way the website operates or the law changes. The current version is always available on this page.
